This page is a reader's guide to the legal case dossiers in the TalkOrigins Archive. It explains the parts of a United States court record most useful for following creation-science, intelligent-design, and public-school science cases.
Legal records are not organized like essays. A useful path is often: identify the challenged rule, read the decision for the court's reasoning, then use testimony, depositions, and exhibits to understand how the factual record was built.
Creation-science and intelligent-design school cases are usually civil lawsuits. The court is deciding whether a law or school-board action is lawful, not whether someone committed a crime.
A bench trial is decided by a judge. McLean and Kitzmiller were bench trials, which is why the written findings explain both the facts and the legal reasoning in detail.
Historically, common-law courts awarded legal remedies such as damages, while courts of equity could order or prevent actions. Modern federal courts can handle both kinds of remedy, but older records may still use that vocabulary.
